    MEXICO CITY – With 34 votes in favor of the Morenistas, the united commissions of Justice and Health approved, with changes, the opinion to the draft bill with a project of decree by which the Federal Law for the Regulation of Cannabis is issued.

    The resolution was approved with 34 votes in favor of the Morenistas, 11 against and 12 abstentions. It was sent to the Board of Directors for the pertinent regulatory effects and in the Plenary the discussion in particular will take place.

    The federal deputies decided to make a major surgery to the minute approved by the senators last November, the creation of the Mexican Institute for the Regulation of Cannabis was eliminated.

    The Federal Law for the Regulation of Cannabis consists of the following.

    The objective is the regulation of the production and commercialization of cannabis and its derivatives, under the approach of free development of the personality, public health and respect for human rights.

    It is specified that in the case of medicinal, palliative, pharmaceutical or cosmetic uses, as well as the scientific use for such purposes, the provisions of the General Health Law and other applicable regulations will apply.

    It details that the production of cannabis and its derivatives will have the following purposes:

    Self-consumption: home production for personal use for recreational purposes and production by cannabis associations for consumption by associates for recreational use; production for marketing and sale for recreational purposes; production for research purposes, and production of hemp for industrial purposes.

    Persons over 18 years of age may consume psychoactive cannabis.

    Consumption must not affect third parties, especially minors. The consumption of cannabis is prohibited in places called “100% smoke-free”, as well as in public and private schools of any educational level. Signs, logos and emblems established by the National Commission against Addictions will be posted in such places.

    It specifies that the sale of psychoactive cannabis and its derivatives for recreational use will be carried out exclusively within the national territory, in the establishments authorized by the Commission under the terms of this Law. The consumption of psychoactive cannabis for recreational purposes by persons under eighteen years of age is prohibited.

    The law also states that, after the granting of the corresponding permit by the Conadic, any person over 18 years of age may cultivate and possess in his/her habitual place of residence up to six cannabis plants exclusively for personal consumption for recreational purposes. The plants must remain in the authorized dwelling or house. Where more than one consumer over 18 years of age resides, the number of plants shall be a maximum of eight.

    After the corresponding permit has been granted by Conadic, persons over 18 years of age may form non-profit cannabis associations to cultivate and possess psychoactive cannabis plants for the consumption of their associates for recreational purposes. The associations must be constituted with a minimum of two and a maximum of 20 persons of legal age.

    The law also states that any person producing or distributing cannabis and its derivatives for marketing and sale for recreational purposes will require a license. The licenses will grant the right to carry out, totally or partially, the activities of the productive chain of cannabis and its derivatives for sale, in authorized establishments, for recreational purposes to persons over 18 years of age.
