Judge ordered Guanajuato Civil Registry to issue new judgment to marry Monica and Edith

In September 2020, Monica and Edith wanted to get married, but they were denied this right. The Civil Registry of Guanajuato argued that marriage is only celebrated between a man and a woman. The young women turned for legal help to the delegation of the Federal Institute of Public Defense (IFDP) in the state.
The legal advisor, María Ramírez, filed a defense action to enforce the rights of equality and non-discrimination, contemplated in Articles 1, 4 and 133 of the Constitution. The IFDP-Guanajuato advisor argued that this refusal violates the dignity and integrity of persons.
In November 2020, the First District Judge granted the protection of federal justice to Monica and Edith, by considering unconstitutional article 72 of the IFDP-Guanajuato’s Regulation unconstitutional Article 72 of the Civil Registry Regulations in relation to Article 144 of the Civil Code of the State of Guanajuato, since they violated the right to equality and non-discrimination by preventing same-sex marriages. The effects of the amparo consisted in disincorporating the aforementioned articles from the legal sphere of the young women.
The judge ordered the Civil Registry to issue a new official notice to grant the marriage request with the formalities established by law. In compliance with the sentence, the officer of the Civil Registry informed that support will be given to Monica and Edith with the procedure, and asked to define the date to carry out said union, as well as to present papers and pay the corresponding fees.
